Protests, US Visa Holders, and Business Continuity
The April 5, 2025 protest turnout was pretty impressive, nationally. From a GC perspective, however, if you employ a lot of visa holders (e.g., green cards, H1B, L-1 or 2, etc.), and, especially if your visa holders hold strategic positions within your company, you might want to send them a quiet word that it’s not clear what or how much constitutional protections they have in the United States. These are questions currently being worked out in the courts, and that they should consult their immigration attorneys. Ultimately, your employees can and will make their own decision as to whether or not to participate in future protests. But, at least, they would have been advised, and you would have done your part as GC to help protect your employees and safeguard business continuity.
